Tenant Improvements (Known as "TI")


This section defines changes or additions to the premises' interior. TI is usually constructed and completed before lease commencement. Quality of the TI or additional work may also be defined here.

What it means to the tenant: 

Is it the landlord or tenant who pays to get the space in the condition a tenant needs to open for business? Or is there just a tenant contribution? This section may also describe in what condition and how the premises are to be returned when the lease terminates. 

Why it's in the lease: 

It describes in what condition the tenant accepts the premises and what improving can or will be done during the term.

Risks to the tenant: 

Tenants need to remember that the property and premises are the landlord’s. Permission to do any renovation or interior construction is generally restrictive and held to a high standard.

Points of negotiation: 

Another money-saving area of interest, particularly to the tenant. Trading free rent for a landlord’s reluctance to provide TI can usually offset some or all of a tenant’s start-up costs.
